The legal proceedings surrounding the tragic deaths of Kiernan “AKA” Forbes and Tebello “Tibz” Motsoane have reached a significant turning point. During their appearance at the Durban Magistrate’s Court on Friday, April 10, 2026, brothers Siyabonga and Malusi Ndimande officially withdrew their bid for freedom.
A Shift in Legal Strategy
Despite previously indicating their intent to apply for release, the Ndimande brothers have now opted to abandon their bail application. This decision ensures they will remain behind bars as the state prepares for what is expected to be a landmark trial.
KwaZulu-Natal National Prosecuting Authority spokesperson Natasha Kara confirmed the shift, noting that while the accused had initially advised they would seek bail, they formally abandoned the request during today’s proceedings.
The Road to July
The brothers are part of a group of seven suspects allegedly linked to the fatal shooting outside a Florida Road restaurant in February 2023. Their journey to this court appearance has been a long one:
- The Flight: Following the 2023 shooting, the Ndimande brothers fled to Eswatini.
- The Arrest: They were apprehended by Eswatini authorities and eventually extradited to South Africa in 2025.
- The Remand: They currently remain in custody alongside five other co-accused.
Trial Countdown
The judiciary has now fixed a definitive timeline for the case. The trial is officially set to commence on July 20, 2026.
