
The Economic Freedom Fighters (EFF) leader, Julius Malema, has secured a critical legal lifeline. Shortly after being handed a five-year prison sentence by the East London Regional Court, the magistrate granted Malema leave to appeal the duration of his punishment, allowing him to remain free for the time being.
The Sentencing Breakdown
Magistrate Twanet Olivier delivered her final judgment on Thursday, April 16, 2026. While Malema faced multiple penalties, the court ordered them to run concurrently, resulting in an effective five-year term:
- 5 Years: Unlawful possession of a firearm.
- 2 Years: Unlawful possession of ammunition.
- Fines/Alternative Jail Time: Discharging a firearm in a public space and reckless endangerment.
- Unfit to Own a Firearm: Malema has been officially stripped of his right to possess weaponry.
Standing Firm on Guilt, Open to Review on Punishment
While the magistrate allowed the appeal, she made it clear that she has not changed her mind regarding Malema’s guilt. Her decision to grant the appeal was based on the legal possibility that a higher court might view the severity of the sentence differently.
“This court has not had a change of heart and clearly stands firm on its decision to convict,” Olivier stated. “However, this court does not have any intention to stand in the way of [a higher court reaching a different conclusion on sentencing].”
A Long Road to Justice
The case, which revolves around the viral 2018 video of Malema firing a rifle at Sisa Dukashe Stadium, has been a marathon for the South African justice system. From his first appearance in 2021 to the full trial in 2022 and the conviction in October 2023, the proceedings have faced numerous delays.
For now, the “Commander-in-Chief” remains free on warning. The next chapter of this legal saga will move to a higher court, where his legal team will fight to overturn the five-year prison term.
