The East London Regional Court found Malema guilty on several serious counts, including:

  • Unlawful possession of a firearm and ammunition.
  • Discharging a firearm in a built-up or public area.
  • Reckless endangerment.

The 2018 Incident

The case centered on a viral video from the EFF’s 5th-anniversary celebrations at Sisa Dukashe Stadium in 2018. In the footage, Malema was seen firing what appeared to be a semi-automatic rifle into the air in front of thousands of supporters. While the defense argued the act was a harmless celebration using a “toy” gun, the court rejected this narrative.

The Judgment: “Deliberate and Arranged”

Magistrate Twanet Olivier was firm in her sentencing, dismissing the idea that the incident was impulsive. She argued that the act was a “grave concern” and clearly planned:

“How can a court consider that the actions of the accused did not entail the intention to commit the offence? Any other conclusion would be nonsensical.”

Beyond the criminal charges, Olivier highlighted the social cost of the lengthy trial. She noted that the massive security and manpower required for the proceedings often blocked ordinary citizens—such as grandmothers seeking guardianship or mothers seeking maintenance—from accessing the court.

What’s Next for the CIC?

Malema has officially been declared unfit to possess a firearm. However, this is likely not the final chapter. His legal team has confirmed they will appeal both the conviction and the five-year sentence in a higher court. As the appeal process begins, Malema remains a free man for now, but his political future hangs in a delicate balance.
