Former PSL player Shaune Mogaila has pleaded guilty to culpable homicide and failing to render assistance following a fatal 2024 Tembisa crash.

Former Premier Soccer League footballer Mokete Shaune Mogaila has been convicted after pleading guilty to culpable homicide and failing to render assistance following a fatal road crash in Tembisa.

The case stems from a collision on 30 October 2024 that claimed the life of nine-year-old Gomolemo Mavimbela and left two members of her family seriously injured.

Mogaila appeared before the Tembisa Magistrate’s Court, where he admitted in his plea statement that he had negligently caused the crash.

According to the National Prosecuting Authority (NPA), Mogaila’s vehicle veered into oncoming traffic on Andrew Mapheto Road before colliding with another vehicle.

Mogaila convicted after guilty plea

The guilty plea resulted in convictions on charges of culpable homicide and failure to render assistance.

NPA communications officer Magaboke Mohlatlole confirmed the conviction, saying the crash resulted in the death of Gomolemo and serious injuries to her mother and 13-year-old brother.

The prosecution welcomed the conviction as an important step towards justice for the victims.

However, the case remains ongoing because the court has yet to determine Mogaila’s sentence.

Sentencing scheduled for November

Mogaila remains out on R20,000 bail, which has been extended until his next appearance.

The former Sekhukhune United player is expected back at the Tembisa Magistrate’s Court on 17 November 2026, when sentencing is scheduled to take place.

The AfriForum Private Prosecution Unit had previously raised objections to proposals it believed could have resulted in a more lenient outcome for Mogaila.

Its spokesperson, Barry Bateman, also expressed concerns about the extent of the account provided by the former footballer regarding the circumstances surrounding the crash.

Case continues to draw attention

The conviction marks a significant development in a case that has remained before the courts since the 2024 collision.

For the Mavimbela family, however, the proceedings follow a devastating loss. Nine-year-old Gomolemo died in the crash, while her mother and teenage brother survived with serious injuries.

Mogaila’s conviction has now been recorded, but the next major stage of the case will be the sentencing hearing on 17 November 2026.

The court will determine the appropriate sentence when Mogaila returns for his next appearance.
